Greetings from Naples, Florida!

 

Hello everyone. It's been a little while since my last mailing. I have been working with visiting Buyers. Inventory seems to have peaked around late March and has been decreasing since. The BIG question is -  Is that it? Will late March 2007 be the highest point inventory-wise or will we be higher in March 2008? One thing that led to this was the additional inventory of new homes and condos purchased to be resold. But that large increase of  inventory most likely won't happen again because the cycle is basically over. In other words, the large percentage of those particular properties are completed or listed. Though we may have peaked in that respect, prices should remain under pressure thru the summer. Pushing listing price is certainly still in the cards. A Florida Land Trust is set up and designed solely for the purpose of holding real estate. A land trust can be used for a plethora of reasons, most notable:

  1. Partnership Agreement. A land trust can be used in lieu of a partnership where two or more parties are involved in a transaction. The agreement can spell out and eliminate various pitfalls including a buy out provision when one party wants out.
  2. Anonymonity. Numerous times I have set up and served as a trustee for an undisclosed buyer for reasons often best known to them. They may also not want the seller to know who is submitting the offer.
  3. Probate Avoidance. Many folks, particularly out of state residents, are forced to go through the time, money and expense of probate. This can be easily avoided if the property was titled in a land trust with successor beneficiary designations.
  4. Estate Planning. Often shares can be gifted to children tax free thereby reducing the size of the parents taxable estate. Similarly, foreign investors may reduce the amount subject to taxation by diversifying their interest with the inclusion of other family members.

In short, Florida Land Trusts are neither new or novel. While a party may not claim homestead status using a land trust (similar situation with Limited Liability Companies), often times the benefits far outweigh the modest cost (approximately $400.00 to $500.00) to set up.
